Preamble

Thank you for using 享悦雅思 member services. Recently, XiangYue has updated and optimized the content of the "Member Service Agreement". This version mainly adjusts the corresponding clauses for jurisdiction. Please read this member service agreement (hereinafter referred to as "this Agreement") in detail before using 享悦雅思 member services. Please read carefully and fully understand each clause, especially the clauses that exempt or limit liability, applicable law and dispute resolution clauses.

The content of this agreement includes the main text of the agreement, other agreements explicitly cited below this agreement, and various rules that 享悦雅思 has published or may publish in the future. All rules are an integral part of this agreement and have the same legal effect as the main text of the agreement.

Special Notice: After you activate member services through 享悦雅思's designated channels, the specific services you can actually use may differ due to different software versions, devices, operating systems, and third-party reasons. You understand the inconvenience this may cause.

1. Definitions

1. 享悦雅思 VIP Service (or "Member Service") refers to the exclusive services provided by 享悦雅思 after users pay a certain service fee according to the method specified on the 享悦雅思 service page, including but not limited to IELTS speaking materials, IELTS speaking mock exams and other existing and future benefits. The specific benefits are subject to the product service page.

2. Please read the VIP service and various benefits carefully before purchasing. Your purchase/renewal/redemption or other payment for this service or the benefits under this service shall be deemed as your recognition and acceptance of the price indicated for the service or benefit; given that this service is a virtual service, after you successfully pay the consideration, the service or benefit will take effect immediately, and except for statutory circumstances, it cannot be transferred or refunded.

3. To meet your needs for continuous procurement of 享悦雅思 services, 享悦雅思 has launched an automatic renewal service. Please read the relevant rules for automatic renewal carefully before subscribing:

3.1. The member automatic renewal service is divided into two types: continuous monthly membership and continuous annual membership. The specific membership type, duration, rules, etc. are subject to the subscription page display.

3.2. If you choose the automatic renewal service, you can cancel the automatic renewal through Apple in-app payment, WeChat payment, Alipay payment, etc.

3.3. After activating 享悦雅思 member services, users can use your account on different devices. Users acknowledge and agree that 享悦雅思 has the right to set the total number of terminals for your same account to be used on different device terminals.

3.4. 享悦雅思 will provide services in accordance with this agreement, but does not promise to solve problems caused by users themselves.

2. Account Usage Rules

1. You can browse course information on 享悦雅思. If you wish to learn the course, you need to log in to your account first, or register an account and log in.

2. You confirm: You are a natural person, legal person or other organization with full civil rights capacity and full civil conduct capacity, and have the ability to independently bear responsibility for all your actions using 享悦雅思 services.

3. The account name, avatar, personal profile and other account information you fill in, log in and use when using 享悦雅思 services should comply with laws and regulations, and should not have the following circumstances:

(1) Violating the constitution or laws and regulations;

(2) Endangering national security, leaking state secrets, subverting state power, undermining national unity;

(3) Damaging national honor and interests, damaging public interests;

(4) Inciting ethnic hatred, ethnic discrimination, undermining ethnic unity;

(5) Undermining national religious policies, promoting cults and feudal superstitions;

(6) Spreading rumors, disrupting social order, undermining social stability;

(7) Spreading obscenity, pornography, gambling, violence, murder, terror or inciting crime;

(8) Insulting or defaming others, infringing on the legitimate rights and interests of others;

(9) Containing other content prohibited by laws and administrative regulations.

If users log in and use account avatars, personal profiles and other account information that contain illegal and bad information, 享悦雅思 has the right to take measures such as notifying for correction within a time limit and suspending use.

4. You should keep your account and password properly. If you fail to keep your account and password properly and cause damage to yourself, 享悦雅思 or third parties, you will bear full responsibility.

5. Account Security Standards

(1) Your account is set and kept by yourself. It is recommended that you keep your account properly.

(2) Your account is only for your own use and may not be lent or shared with others.

(3) If you find any unauthorized use of your account, it is recommended that you notify 享悦雅思 customer service immediately.

(4) You should be responsible for all actions and results under your account.

3. Data

Unless otherwise proven, the data stored on 享悦雅思's servers is the only valid evidence of your use of 享悦雅思 services.

4. 享悦雅思 Usage Rules

1. You must bear legal responsibility for your actions in the process of using 享悦雅思 services.

2. You understand and agree that 享悦雅思 has the right to provide the necessary information you submit to 享悦雅思 or store on 享悦雅思 servers when using 享悦雅思 services to the competent authorities upon request.

3. You promise:

(1) Comply with all laws and regulations, network protocols, procedures and practices regarding the use of network services;

(2) Without permission, do not delete, modify or add data and applications stored, processed or transmitted in the 享悦雅思 platform;

(3) Do not intentionally create or spread destructive programs such as computer viruses;

(4) Other acts prohibited by laws, regulations and administrative rules.

4. If you violate 享悦雅思 usage rules, 享悦雅思 may immediately suspend providing you with some or all services.

5. If your behavior on the 享悦雅思 platform violates relevant laws and regulations, 享悦雅思 may report to the relevant competent authorities in accordance with the law.

5. Intellectual Property

1. Unless otherwise agreed or 享悦雅思 otherwise declares, all intellectual property rights and related rights of all content in the 享悦雅思 platform belong to 享悦雅思 or 享悦雅思 affiliates.

2. The logo, graphics and their combinations of the 享悦雅思 platform, as well as other identifiers, product and service names of the 享悦雅思 platform are trademarks of 享悦雅思 or 享悦雅思 affiliates.

3. 享悦雅思 has full intellectual property rights to 享悦雅思's proprietary content, original content and other exclusive or exclusive content obtained through authorization.

6. Other Provisions

1. Force Majeure: 享悦雅思 is not liable for losses caused by force majeure.

2. Service Suspension, Interruption and Termination: 享悦雅思 may choose to suspend, interrupt and terminate platform services due to its own business decisions and other reasons.

3. Ownership and Intellectual Property: All content on the 享悦雅思 platform is legally owned by 享悦雅思 or other rights holders.

4. Notice: All notices sent to you can be transmitted by email, regular mail or announcement in a prominent position on the website.

5. Changes to Agreement: 享悦雅思 may modify this agreement from time to time according to changes in national laws and regulations and 享悦雅思 platform service changes and business development needs.

6. This agreement shall be implemented from the date of publication and constitutes a consensus between you and 享悦雅思.

7. 享悦雅思's failure to exercise, timely exercise or fully exercise the rights enjoyed under this agreement shall not be deemed as a waiver of such rights.
